User - the one who wishes to use the Service and who accepts its General Conditions.

Service - all content, services provided and products provided, directly or indirectly, through this website, whether or not they imply any type of economic transaction or of any other nature.

Internet - world wide web of computers that share resources with each other.

B - Service Provider

C - Use of the Service

You agree to use the Service in a manner consistent with the laws and regulations applicable to this type of Service and in accordance with the Terms and Conditions set forth herein. Tinta nos Nervos, reserves the right to change part or all of the content contained in these Terms and Conditions at any time and without prior notice. The User shall be solely responsible for the use of the Service. The User may not access the Service under any circumstances to commit or link to fraudulent acts or acts that result in a criminal offense; attempt and/or alter any content on the Service; transmit any material or message that contains computer viruses, is causing any damage or has contaminating intent or effect.

By accessing the Service, the User declares to meet all the legal conditions for the use of it, including being at least the minimum legal age to do so (thirteen years old). Otherwise, you must immediately cease using the Service.

D - Limits of liability

You agree that entry, browsing and any purchase you may make at Tinta nos Nervosor other associated companies is at your own risk and that Tinta nos Nervosis not liable for any damage that may occur to you as a result of your use of the Service. If the User uses this Service to access any Services external to this Service or from third parties, he/she must first be aware of the conditions of use of these Services, as these are not included herein. Although every effort is made to ensure the accuracy and quality of the information provided, Tinta nos Nervosdoes not guarantee that the information, its own and/or that of third parties, made available through this Service, is complete, accurate and up-to-date. Tinta nos Nervosdoes not make any warranties with respect to the availability or performance of the Service. Tinta nos Nervosis not responsible for any failure of the communications network supporting the Service, or for any other reason, that causes any failure, interruption or delay in any operation that the User intends or is performing, and is not attributable to him any damages or losses that the User may suffer.

E - Conditions of Access to the Service

Access to this Service is free of charge for the User. The acquisition of additional Services and products with associated costs is dependent on the express indication of their acceptance by the User, namely through the explicit and unequivocal order confirmation. This confirmation may, however, be made by other means and/or Services external to this Service. The User is responsible for paying for the telephone calls made and any other telecommunications costs for the use of the Service to the operators from which the communications originated.

Basic access to the Service does not require prior registration by the User. However, in order to have access to some additional features, namely the purchase of products and services, as well as more personalized information, the User will have to register.

The User shall be solely responsible for his/her registration data, including his/her username, email address and password to access the Service. Tinta nos Nervosshall not be liable for any damages or injury suffered by the User or third parties as a result of the use of his/her data registration, with or without your knowledge. The Registered User must keep his/her registration data confidential, preventing its use by third parties.

F - Access to information

The entities providing the Service may have access to the content of the messages sent and/or received by the user, with the consent of the user, by virtue of the law or a court decision or when, for reasons of force majeure, access is necessary.

G - Use of Users' data

For all legal purposes of personal data protection and database management, the User is considered a customer of Tinta nos Nervosfrom the moment he registers for this Service, even if no economic transaction is carried out. By registering, the User authorizes Tinta nos Nervos, which manages the service, to use the personal data provided at the time, as well as to use the information arising from the queries and transactions carried out for automatic administrative and statistical processing, for the future presentation of its products and services, under the terms that may be defined by the National Data Protection Commission. The user is always guaranteed access to their data, its rectification or deletion under the terms of Law 67/1998, of 26 October and Law 69/1998, of 28 October. Tinta nos Nervos, through its legal representatives, will be responsible for the personal data provided through this Service, or others associated with it, recorded in its database. The User should also take into account that he is sending his data through open networks, namely the Internet.

H - Prices

All values should be considered as indicative only and are subject to confirmation and/or change without prior notice.

The base currency for all transactions will be the euro. Any values expressed in other currencies are indicative only and may not correspond to the prevailing exchange rate.

Unless otherwise stated, all values include VAT at the legal rate in force. Preparation, transport and/or payment method expenses may be added to the values presented, which will be calculated and confirmed during the order completion process. For more information, please refer to "How to Buy".

In case of doubt about the total final amount to be paid, the User should contact the services of Tinta nos Nervos.

I - Cancellations, Exchanges and Returns

The User may cancel their order at any time until the effective shipment of the products and/or provision of the services ordered.

Any order will only become effective after confirmation of your payment.

Tinta nos Nervos, under the terms of Decree-Law No. 7/2004 of 7 January (as amended by Decree-Law No. 62/2009, of 10 March and by Law No. 46/2012, of 29 August), reserves the right to unilaterally cancel the order whenever computer errors occur, data entry or others that call into question the respective contract.

The delivery of products purchased through this Service will fully comply with the rules applicable in Portugal to the various branches of distance trading, namely Decree-Law No. 24/2014 of 14 February (as amended by Decree-Law No. 47/2014 of 28 July), which includes a period of 14 days during which the Client/User can terminate the contract without the need to give any reason. This period will be counted from the moment the consumer, or a third party indicated by him other than our carrier, acquires physical possession of all the goods ordered or, in the case of the acquisition of services, from the day on which the contract was established. À Tinta nos Nervosreserves the right to only accept the return of products that are presented in their original packaging and without any signs of use. The Customer/User will be responsible for all possible logistical expenses inherent to the delivery and return process of these products.

Except for a manufacturing anomaly, returns/exchanges will not be accepted for items that have been produced according to the customer's specifications or have undergone any type of customization, items that for hygiene reasons are not suitable for return or whenever the return period indicated above has already been exceeded.

Any return process must be previously communicated by the Customer/User and authorized by our services.

In case of effective return, the refund of the amount will only be made after the validation of the return conditions described above and, after receiving the goods at our facilities, it will be made within a maximum period of 14 days.

 J - Guarantees

Notwithstanding any legal provision to the contrary, pursuant to the provisions of Decree-Law No. 67/2003, of 8 April, as amended by Decree-Law No. 84/2008, of 21 May, and other legislation in force, all products supplied and services provided by: OWNER_SHORT_NAME: they are covered by a guarantee at the time of their supply. Consumable or fast-wearing products (i.e. ink cartridges, toners, batteries, etc.) may have warranty periods shorter than usual for other equipment. The Client/User should also bear in mind that the current law assigns a minimum warranty period of 2 years for end users (non-profit) and 6 months for companies (and other for-profit customers), prevailing for the attribution of this period the data contained in the invoice, or other document that replaces it, issued at the time of acquisition, as well as its respective date. In general, the warranty terms cover any malfunctions caused by manufacturing defects and/or others attributable directly to the manufacturer, not covering improper use of equipment, software misconfigurations, natural wear and tear or other situations attributable to the Customer/User. In cases where the warranty terms do not apply, the Customer/User will be notified of this situation and the respective reasons, and the repair will be budgeted whenever possible. Unless otherwise specified, the Customer/User will be responsible for all possible logistical expenses inherent to the delivery and return process of said products under or out of warranty. Any warranty process must be previously communicated by the Customer/User to our technical services and authorized by Tinta nos Nervos, and any products sent to our facilities will not be accepted without prior consent and possible assignment of a repair number. The warranty conditions presented by the manufacturers prevail over the information provided by Tinta nos Nervos, and the latter is not responsible for any errors and/or omissions in the information provided through this Service or any other means under its responsibility or the responsibility of third parties. Some manufacturers have their own warranty processes and service centres, in which case the Tinta nos Nervoswill not be directly responsible for the process. The Customer/User may contact or be redirected to companies external to Tinta nos Nervosin order to obtain technical assistance within or out of warranty regarding products purchased from the latter.

K - Intellectual Property

All content on this website, including but not limited to text, images, videos, software and other intellectual content, is the property of Tinta nos Nervos, its affiliates, partners, suppliers, customers or their respective owners with permission. These are protected by national and international industrial and intellectual property standards.

The reproduction, use, distribution, alteration, copying or other type of communication of the contents of this website outside the scope of the same, without the express permission of Tinta nos Nervosor their respective owners, is strictly prohibited.

L - Cookies Policy

Cookies are files recorded locally by the Service on the device used by the User. These serve to facilitate navigation and use of all the features of the website.

This service uses only temporary cookies, not storing any type of permanent and/or personal information on the device. These have a short duration, intended only for the maintenance of the user's session and for statistical purposes.

At no time are cookies used to store and/or share the User's personal data, nor are they shared with other entities. Only anonymous browsing data is made available to Google Analytics (which you can deactivate by following the instructions in https://tools.google.com/dlpage/gaoptout).

M - Responsibilities of Users

The User shall be liable to Tinta nos Nervosfor any breach or violation of these General Conditions. You will be responsible for any court costs, attorneys' fees, and administrative charges that Tinta nos Nervosyou may incur in claims or lawsuits related to your use of the Service.

N - Termination 

In the event that the User provides false information or misuses the Service or for any purpose contrary to the law, Tinta nos Nervosmay suspend the provision of the Service, without prior notice, without prejudice to the criminal liability that may be attributable to the User.

O - Applicable law and competent jurisdiction

Portuguese law and jurisdiction apply to this Agreement.

In the event of a conflict between these General Conditions of Use and the legislation currently in force, the latter shall always prevail.

A Tinta nos Nervosjoined the Lisbon Consumer Conflict Arbitration Centre (www.centroarbitragemlisboa.pt). In the event of a dispute, the consumer may appeal to this Dispute Resolution Entity, as well as propose the use of another Entity in his area of residence. More information at www.consumidor.pt.

For other disputes arising from this Agreement that cannot be resolved by an Arbitration Center, the jurisdiction of the district of Lisbon is established, with express waiver of any other.
